These Terms govern your use of the Mail Merge Chrome extension, website, and backend at mailmerge.work (the “Service”). The Service is developed and operated by Kirill Valikov, an independent developer (“we,” “us,” or “our”). You can contact us at adsacckir@gmail.com.
By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use it for an organization, you confirm that you are authorized to accept these Terms on its behalf, and “you” includes that organization.
Our Privacy Policy explains how we handle information. For setup and sending instructions, see How it works.
1. The Service
Mail Merge helps you create personalized emails from a Gmail template and rows in a Google Sheet, send them through your connected Gmail account or chosen SMTP provider, and view campaign progress. You choose the recipients, content, spreadsheet, and delivery method.
Review your recipient list, template, variables, attachments, and sending account before starting a campaign. Once accepted, a campaign is processed on our servers. Closing the panel, signing out, or uninstalling the extension does not cancel an accepted campaign. Emails already sent cannot be recalled by Mail Merge.
Test messages help you check personalization but may omit attachments and inline images. Keep your own copies of important content; the Service is not an archive or backup service.
2. Eligibility and account access
You must have legal capacity to enter into these Terms and meet the age and account requirements that apply to you and your connected providers. Use only Google accounts, spreadsheets, sending addresses, domains, and SMTP credentials that you are authorized to access and use.
You are responsible for securing your accounts, devices, and credentials, and for activities you authorize through the Service. Tell us promptly if you suspect unauthorized access to your Mail Merge account. Do not share another person’s credentials or attempt to access their campaigns.
3. Responsible email sending
You are responsible for the lawfulness of your recipient lists and messages. Comply with applicable privacy, direct-marketing, and anti-spam laws, including CAN-SPAM, GDPR, and PECR where they apply, and your email provider’s sending rules. In particular:
Have a lawful basis to process recipient information and obtain consent where required. An address being public, purchased, or available in a spreadsheet does not by itself give you permission to contact it.
Identify the sender accurately. Do not use deceptive headers or subject lines. Include required advertising disclosures, contact details, and a valid postal address where the law requires one.
Provide a clear, working way to unsubscribe from marketing messages. Honor objections and opt-out requests within applicable deadlines and exclude those recipients from future marketing campaigns.
Mail Merge does not automatically add unsubscribe links or manage a suppression list for you. You must provide and maintain those arrangements yourself. Using the Service does not establish consent or make a campaign legally compliant.
Impersonate another person, misrepresent your identity, or infringe privacy, intellectual property, or other rights.
Bypass sending quotas, provider restrictions, authentication, security controls, or an account suspension.
Probe or access systems without authorization, disrupt the Service, or interfere with other users’ accounts or data.
We may investigate reports and restrict activity when reasonably necessary to address abuse, security risks, or legal obligations. Report suspected misuse to adsacckir@gmail.com.
5. Your content and data
You retain your rights in your templates, messages, attachments, and spreadsheet content. You give us a limited permission to access, copy, store, personalize, transmit, and otherwise process that content as needed to provide the Service under your instructions. This does not transfer ownership to us or authorize unrelated advertising use.
You confirm that you have the rights and permissions needed for this processing and for delivery to your recipients. Where you decide why and how recipient personal data is used, you are responsible for the notices, lawful basis, and instructions for that use. Our own data-protection obligations continue to apply.
Data handling, Google API Limited Use restrictions, retention, and deletion are described in the Privacy Policy. These Terms do not expand the uses of Google data permitted by that policy. Content from completed campaigns becomes eligible for cleanup after seven days; some account and campaign-history records remain longer. Request account or data deletion using the contact below.
6. Delivery and third-party services
The Service depends on Google, Chrome, your SMTP provider, hosting and network services, and recipients’ mail systems. Their terms and policies apply to your use of them. Mail Merge is an independent service and is not endorsed by Google.
Sending limits, filtering, outages, revoked access, account restrictions, and provider changes can delay or prevent delivery. A “sent” status generally means the sending provider accepted a message; it does not prove inbox placement, receipt, or reading. We do not guarantee delivery, a particular sending speed, or uninterrupted availability.
Check campaign status before resubmitting a mailing. Interruptions or uncertain provider responses can make it difficult to determine whether a message was accepted, and resending may produce duplicates. Contact us promptly if an active campaign needs attention; stopping pending delivery cannot be guaranteed.
7. Fees
Any fee charged by us, together with applicable payment, renewal, and cancellation terms, will be disclosed before you agree to a paid purchase. These Terms alone do not authorize a charge or subscription. Your Google, SMTP, internet, or other providers may charge separately under their own agreements.
8. Service ownership
We and our licensors retain the rights in the Service’s software, design, and branding. Subject to these Terms, you may use the Service for its intended purpose. You may not resell access, copy or distribute our software without permission, or remove ownership notices, except as allowed by applicable law or a relevant open-source license. Third-party components remain subject to their own licenses.
9. Suspension and ending use
You may stop using the Service at any time, remove the extension, and revoke Google access through your Google Account connections. To close your Mail Merge account or request deletion, email adsacckir@gmail.com from the connected account. We may verify your identity.
Signing out, revoking Google access, or uninstalling does not automatically erase server records or cancel an accepted campaign, including one using SMTP. Deletion also does not remove messages already delivered or copies held by Google, your SMTP provider, or recipients.
We may suspend or end access if you materially breach these Terms, create a security or abuse risk, or if required by law. Where reasonably practicable and lawful, we will explain the reason and give you an opportunity to resolve the issue. Urgent protective action may be immediate. You may contact us to ask for a review. Retention after termination follows the Privacy Policy and applicable law.
10. Warranties and liability
We will provide the Service with reasonable care and skill. To the extent permitted by applicable law, it is otherwise provided “as is” and “as available,” without additional warranties of merchantability, fitness for a particular purpose, or error-free operation.
To the extent permitted by law, we are not liable for indirect or consequential losses, or lost profits, revenue, or business opportunities arising from use of the Service. You remain responsible for your own content, recipient selections, and sending instructions. This does not excuse our failure to meet obligations that apply to us by law.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer rights, remedies, and data-protection rights remain unaffected. Where an exclusion is not permitted, it applies only to the extent the law allows.
11. Changes to the Service and Terms
We may update the Service and these Terms to reflect functionality, security, legal requirements, or operational needs. The current Terms will be available here with an updated date. For material changes, we will provide reasonable advance notice through the Service or an account contact method where practicable, and any notice or consent required by law. Urgent legal or security changes may take effect sooner, with an explanation where lawful.
Changes apply prospectively. If you do not agree to revised Terms, stop using the Service and contact us about closing your account. Continued use after the effective date constitutes acceptance only to the extent permitted by law; we will seek express agreement where required. If we discontinue the Service, we will give reasonable advance notice where practicable.
12. Disputes and contact
Please contact us first if you have a problem so we can try to resolve it. This does not prevent you from seeking a remedy from a competent court or regulator, or reduce any applicable legal deadline. Applicable law determines the law and courts governing a dispute; these Terms do not require arbitration or waive mandatory local consumer protections.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive it for the future.
